Back Ground

We had already updated the board in the update dated 6^th November 2002, about the scenario, and compelled FFCL to take up the responsibilities more than initially decided.

We would like to draw your attention on few more, self appointed problems because of lack of far sightedness.

• We don’t know why the few local committees are pressurizing victims to go back to their original places, where they had been butchered and raped. However, what we feared is coming up as a sad reality. The victims who returned to their original places whether forcefully or willingly will not be able to fight the legal battle. They do not have the courage to appear in the courts and identify the accused, who are locals and powerful. 

1.    The Naroda Patiya, which saw the worst carnage of its kind, is at present facing another hostility. After elections, suspicious people are moving in plain cloths claiming that they are from police department. They are moving with a list, having names of Muslims. The so-called police personnel are inquiring the where -about of a number of Muslims. The returned victims are so terrorized that they have again decided to move out of Naroda Patiya permanently. Please refer Appendix “C”. 

2.    The inflated communal ethos of the BJP and VHP leaders has started playing truant in many parts of Gujarat. Every month on date 27, Prahalad Shastri, who has BJP leanings is organizing meets to pay homage to the Godhra victims, BJP MLA’s and ministers remain present at these meets, and as expected these meets are sending out communal waves,  causing incidents of rioting, in turn sending out terror waves to the rehabilitated Muslims, making them once again to flee to relief habitats. Please refer Appendix “D”.)

    3.    Not only the relief resources have gone in vain, but it will 

         hamper the trial also.  

Back to work, the trial of few cases has already begun; many are in pipeline and may be started soon. It will be very time consuming if we will go in details in all the cases. I would like to mention details of few trials etc, and brief about others. A detailed table is given in Appendix “01).

Ghodasar Carnage update

Object:

1. To incorporate named accused in Police investigation report so that the accused  can face the Trial.

2. Oppose accused bail applications in respective courts, so that the accused should remain in Jail, and witnesses should not have fear.

22 Accused, No. 41 to 62 are in Jail. 

Accused No. 41 to 62 bail application No. 702/02 was rejected on dated 24/9/02 by Additional Session Judge, Nadiad.  

Accused No. 41 to 62 Bail. Cri. Misc. Application No. 7360/02 is pending in High Court.

Released on bail dated 17/8/02 by Shrimati S. A. Dave Additional Session judge, Nadiyad.  

Trial Status:

The charges have been framed in session court and it is expected that the trial will start from Feb./March 2003.

(It is requested to please read and understand problems faced by Gujarat victims mentioned in our first chapter and than only analyse the results.)

1. All death names have been included in charge sheet and death compensations have been paid to every victims.  

2. Death accused ratio is near 5. For each murder 5 accused have been named.

3. Almost all accused have been arrested leaving few.

4. 22+3 numbers of accused are still in jail.

5. Absconding are real absconding and even they have been  arrested after formation of new BJP Government.

6. Charge sheet is clear and no ambiguity is doctored in it.
