Supreme Court issued notices to Abassana Accused

All 30  accused of Abassana carnage had applied for bail in  Gujarat High Court. In the month of Oct 2002, 27 out of 30 accused  were released on bail. 

A SLP was filled in the Supreme Court for the cancellation of bails granted to  the 27 accused by Gujarat High Court. It is the victory of justice that honorable Supreme Court has issued notices to all 27 accused for their bail cancellation. The notices was issued by the Honorable Judges of the Supreme Court in the month of  March, after the argument, established by Senior Supreme Court lawyer Mr. Salman Khursheed and Mr. Imtiyaz Ahmed.

Purpose: 

In order to give justice to  the victims it was decided that. 

(A) All accused should be named in Charge Sheet, so that they should face trial.

(B) They should be arrested and should not be declared absconding as  per             general practice in Gujarat.

(C) They should not get bail, so that they can feel and realised that in India         Justice system is alive.

Achievements:

(It is requested to please review the achievements in the light of Gujarat scenario.)

 

(A). All death names have been included in charge sheet and death    

      compensations have been paid to every victims.  

(B) All the accused have been arrested and no absconding is declared in this  

      case.

(C) 3 main accused are still in Jail.

(D) 27 accused out of 30 were in Jail for 8 months. They were granted bail

      through Gujarat High Court only.

(E) Supreme Court has issued notice for bail cancellation to all the  27 accused.

(F) You are aware that legal expenses of Supreme Court are     costly and distanced. That is one of the reason that the accused        are offering huge  amount to the victims for the compromise.

(G) Therefore we can say that Justice System in India is still alive.

      What is required, is the thirst, zeal  and thrust for Justice.

(H) Death accused ratio is 5,means for each murder 5 accused have

      been named.

Legal Build Up
  1. Accused no. 1 to 22 were arrested on date 06/04/02 at 11:30 AM.

  2. Accused no. 23 to 25 were arrested on date 06/04/02 at 12:15 AM.

  3. All accused were produced before magistrate court on date 07/04/02 Court has given three days to police remand.

  4. Accused no. 26 to 28 were arrested on date 07/04/02 at 17:00 PM. All accused were produced before magistrate court on date 08/04/02 Court has given two days to police remand.

  5. All 28 accused were produce before court on date 10/04/02 and court ordered to send them in judicial custody (Jail).

  6. Accused no. 29 was arrested on date 10/04/02 at 7:00 AM and he was produced before court and was send in judicial custody.

  7. Accused no. 30 was arrested on date 10/04/02 at 7:00 AM. And he was produce before court and was sent in judicial custody.

  8. Accused no. 31 arrested on date 10/04/02 at 7:00 AM and he was produced before court and was sent in judicial custody.

Bail opposed:

Session Court rejected bails of 30 accused on 29/07-02

Accused No. 30 was released on bail under Cr, Misc. Application No. 394/2002 by Shri B. N. Talvani Additional District Sessions Judge Ahmedabad (Rural) and other bail applications of accused No. 1 to 29 and 31 was rejected under Cr. Misc. Application No. 398/2002, 467/2002 and 608/2002 by Shri B. N. Talvani Additional District Sessions Judge Ahmedabad (Rural) on date 29/07/02.

High Court:

After 8 months bail granted to 27 accused by High Court

3 main accused are still in jail

In the month of Sept 2002. All 30 accused applied for bails in High Court.On dated 03/10/02, Affidavit of Zubaidaben Dawooddbhai Ghanchi (Eyewitness) filed in high court against the 3 pending bail applications of the accused. The accused withdrawn the bail applications.

Later on they re-applied the bail in High Court. Matter came for hearing on 16-10-02.  The following CMA were filed by accused

Again bail was opposed, however Hon' able Justice Akshay Mehta granted the bail to 27 accused. Bail was rejected for 3 main accused.
